Jury: Voorhees president sexually harassed professor

COLUMBIA – A jury late Thursday found that a former Voorhees College professor was sexually harassed by the college’s president Lee E. Monroe and that Voorhees College “acted with malice or with reckless indifference to the federally protected rights” of the former professor.

Dr. Moreen B. Joseph brought the civil lawsuit against Monroe and Voorhees College, alleging that Monroe sexually harassed her and the college did nothing about it.

The jury awarded Joseph punitive damages of $400,000 and compensatory damages of $100,000.

The trial before U.S. District Judge R. Bryan Harwell Monday at the Matthews J. Perry Jr. Courthouse in Columbia and the jury came back with the verdict last Thursday afternoon.

According to the complaint filed in U.S. District Court, District of South Carolina, Orangeburg Division on July 13, 2004, the Louthian Law Firm of Columbia, representing Joseph, alleged that she was subjected to “lewd, gross and suggestive language of a sexual nature and unwanted touching” by Monroe for a period of several months in 2002 and 2003, creating a “hostile work environment.”

Monroe and Voorhees College, represented by Evans Taylor Barnette of McCutchen Blanton Rhodes and Johnson, denied all of Joseph’s allegations.

Joseph claimed that Monroe “repeatedly made unwelcome sexual advances and implied that if she would agree to his sexual advances, she would benefit personally and financially.”

The complaint went on to state that Monroe suggested to Joseph that if she “received his sexual advances favorably, that she would continue to prosper as an employee of the college and implied that if she did not go along with his advances that she would regret that decision.”

Joseph claimed that she “consistently and adamantly rejected ... Monroe’s advances and, as a result, she was retaliated against, culminating in the loss of her position and more than $70,000 per year in income.”

The complaint stated that Monroe and the college “discriminated against and harassed (Joseph), retaliated against her and caused her to suffer damages because of her sex (gender), all in violation of Title VII of the 1964 Civil Rights Act, as amended.”

As a result of Monroe’s conduct, Joseph claimed that she “suffered and continues to suffer severe emotional distress, psychological injury, mental suffering and humiliation.”

The complaint also alleged that Monroe “unlawfully placed his hands on the body of (Joseph) in a sexually suggestive and offensive manner, thereby inflicting a battery upon her person.”

However, the jury Thursday found that Joseph had not proven her claim of battery.

Joseph also alleged that Monroe’s actions and conduct were “pervasive and ongoing and known to the Board of Trustees and other officials” at Voorhees College. The complaint stated that she reported the sexual harassment and assault and battery to appropriate officials at Voorhees including the Human Resources Office and the Board of Trustees.

In answering the complaint, Monroe and Voorhees College denied “each and every allegation” related to sexual harassment and assault and battery.

The defendants, in their answer, acknowledged that Joseph notified one or more college officials, including Monroe, of “claimed sexual misconduct but failed to follow college policies and procedures with regard to investigating said wrongful conduct.”

The answer to the complaint also stated that Joseph was not “terminated or constructively discharged by (Voorhees College). Rather, (Joseph) voluntarily quit and terminated her employment with Voorhees College,” and it called for the suit to be dismissed.

In commenting on the jury’s decision, Don Fowler, Voorhees College Board of Trustees member and spokesperson, said, “The proceeding yesterday (Thursday) was disappointing but there are additional steps before the final determination is made in respect to this proceeding. We continue to have faith and confidence in Dr. Monroe, and I will not have any other comment until the court has concluded all of the steps in this process.”

Herbert W. Louthian, attorney for Joseph, said, “I feel that the jury was very conscientious in their approach to the case. They were attentive, they were diligent, they did their duty and, in so doing ,they have helped us protect the lives of women in the workplace.”

The point is that Dr., i'm sorry Lee has had some problems in the past. He was hired as our president, and now we regret our decision. " SCSU cant take over Voorhees College, because Voorhees is a private HBCU and SCSU is a STATE College, thats like USC taking over Benendict or Allen University. I wish Voorhees Could get some of that State Money, USC, Winthrop, College of Charleston, Coastal Carolina, Lander, ect..We could use the money to up grade some of the dorms, and move from NAIA to NCAA " -vc old head wrote on May 2, 2007 As for this story I seriously hope not. this will go against what the school essentially stood for. Instead, Monroe resigned Jan. 17 with an undisclosed severance settlement and an understanding the report would be sealed. On Monday, after reviewing the reports on Monroe's performance and the college's academic, financial and student affairs, the board of trustees officially accepted Monroe's resignation. Monroe was named president of the private, black college in March 1990 and given a two-year contract. The reviews were prompted by increasing concerns about attrition of the student population, the absence of a fund- raising plan and low morale among Florida Memorial employees, said board of trustees Chairman Wilkie Ferguson. I Love My Alma Mater with all of my heart, but right now my heart is breaking. To see the bare bones of what once was a great institution reduced to this. A lauging stock among other institutions. " I am a Voorhees alum who wants the very best for my alma mater. I have fond memories of my time there and I am extremely proud of the education that I received. This is a dreadfully horrible situation. It is easy to react or respond emotionally, form opinions and make accusations. I've tried to remain as objective as I can in an effort to assess the situation. The facts of this matter are these: Dr. Monroe has been found guilty of sexual harrassment by a jury of his peers in civil court and Voorhees College has been held accountable for not protecting Dr. Josephs' rights in civil court. This has resulted in a $500,000 award in punitive and compensatory damges for Dr Joseph. Incidentally, Dr. Monroe has been charged with sexual harassment on at least on other occasion (the approximate year was 1995). During Dr. Monroe's tenure at Voorhees, the water bill was unpaid resulting in the water being disconnected. The Teacher Education program has not been re-instated as promised. Enrollment at Voorhees has declined. Student retention has declined. The reputation of the college has been damaged. Morale of the students, faculty & staff is very low. It is very, very sad that workers, students, graduates (and people not afflicated with the school at all) are on here arguing with each other. Most of the comments are not regarding Dr. Monroe or his actions, they are either about another comment (and yes I did the same thing, but not in manner of the others) or something that has nothing to do with the case. People are funny that way, always wanting to bring out the wrong and belittle others. Some comments are so off the wall, I'm just scratching my head. Some are just so utterly ridiculous I'm laughing. " After reading every comment that was stated, I've come to the conclusion that Voorhees' image has been tarnished from this devastating incident. I'm a former student, of Voorhees College and of course students are going to complain about the dorms, the food, and the staff. The problem with this lawsuit is that now it has people focusing more on the school, rather than on the problem at hand. Lee Monroe is the accused, not Voorhees. I agree that he should have to pay the lawsuit out of his pockets rather than use funds of the school, because it was his battle lost. I am someone's daughter, sister, aunt, and most importantly mother. I would not want a sexual harraser around my daughter. Voorhees is the same as any other institution, you're getting an education. It is not the professors fault that your child does not care enough to want to learn. I'm speaking from experience. If you don't apply urself whose to blame? Back to the matter at hand, President Monroe does need to be removed from the institution. His personal life is none of my business. However; the best interest of our future leaders is, including myself. I am ashamed that Voorhees would consider anyone as a leader, regardless of his/her past and leadership skills. I'm surprised that Mr. Monroe has so many skeletons in his closet, but not surprised that people would point the blame at the instiution as a whole, rather than the one whose responsible. Faculty and the administration all seem to only be there to collect a check and that is truly sad. I came to Voorhees to get a good education that would allow me to compete globally. Half the time the instructors don't come to class and when they are there class is cut short because they have other things to do. It is a sad state of affairs. If you try to get the status of your student account, youre barking up the wrong tree if there is a credit on the account. What I mean is your credit can not be dispersed because no one has the authority to disperse or to let you know when it can be disbursed. Financial aid and credits to students accounts are not dispersed according to the guidelines by the Feds. Voorhees will not follow the rules! Most of us know that by not dispersing student funds in a timely manner, they are using that money to grow and earn interest for the colleges' account. I do believe that if this is not illegal at the least it is unethical!!!! Grades are not turned in a timely manner. Some students have been in class for 7 months and still have nothing from the college indicating that they are enrolled. It is a sad state of affairs. What really angers me is that we the students are being denied and or cheated by our own people for the same reasons that historically black colleges and universities were founded, because we were denied quality educations at our larger more elite colleges. Then to have our own people engage in this same sort of selfish behavior is really too much. There is so much more that Voorhees is capable of. It has educated some of the finest students in the past. It is time to clean up Voorhees- from the President's office right down to cleaning up the grounds. The buildings are in deplorable conditions and our tuitions are being spent to litigate sexual harrassment cases. If Dr. Monroe had the college's best interest in mind, he should have taken a leave of absence until this was settled. No instructor or student should have to be subjected to this sort of behavior. If an instructor who is more capable of defending herself than a 17 or 18 year old female student. He has set the tone and I am sure there are other instances where other females have been sexually harrassed. Men who do this don't just do this once, there is a pattern. I wonder why the spineless employees won't acknowledge their knowing about what's going on. Remember that woman is someones mother, daughter,sister, aunt or friend and it could have been your daughter, your sister, your mom, your wife or your friend. We as blacks seem to think it is ok to go along with our folk even when they know they are wrong. That is the wrong message to send. I am for right and right only.I give God the glory that when I meet him I will be able to say that I stood for something, what about you? "

" My overarching feeling about this matter is that the stakeholders of Voorhees College should require Dr. Monroe to answer to his misdeeds. Under the umbrella of free speech, concerned students, alumni, employees, and the community must continue to speak up and ask questions. " Whomever is "sick and tired" of this, should either stop reading the comments (that is the only way you'll know what's being written right?) or work to organize Voorhees for better leadership. People feel strongly about this because it is important. No one should try to stop others from speaking out. That's what has Voorhees in the trouble in the first place. I will be graduating soon, and I would like to think that this school will have a bright future, led by administration that cares for it's students, faculty, staff and alumni regardlless of gender. " The meeting Monroe had last week seemed like a damage control meeting. He did boast that he and his wife just increased thier insurance policy to one million dollars. That was a bad move on his wife's part. But if that's true, he should have to pay for this suit out of his owm money. " It truly is a shame that Monroe has come to Voorhees and not only made a mockery of it's image and name, but continues to believe that he is good for this school. Elizabeth Evelyn Wright founded Voorhees for minority students who were unable to get an education from other schools, I am sure she must be turning over in her grave. I think Monroe believes that he is above any form of governance. I have read the posts, and there seem to be a lot of people who know some of his faults. I have met Monroe, and I think he leaves alot to be imagined. He walks around like he is walking on water. When Monroe came to Voorhees (during his interview period) he informed the faculty and staff that it really did not matter to him if Voorhees hired him, because he already had a job, yet he was still hired. With him came his "work-study student" all the way from Texas, and a position was created for her. She also got to live in one of Voorhees' apartments, the only administrative specialist who were priviledged to live in the apartments by the way. I can't imagine that no one thought this young girl coming all the way from Texas, with no family here was a bit odd. My prayers go out to Voorhees, what it truly stands for, and I pray that it can recover from this. "

While he has always seemed to have a good head on his shoulders, the time i was there he was known to be very rude at times with the way he went about things. " This is truly a travesty. By the sheer number of comments this ruling is getting, it is clear that Voorhees College has a public image issues due to the leadership, headed by Lee Monroe. What are we teaching our young people when we foster flagrant philandering tyrants in our instutions? the Board of Trustees needs to be reevaluated in this situation as well for not vehemently and proactively pursuing this issue. How can they still be supportive of him? Is this not a Christian school? How many more women would Monroe have preyed on if this case did not go to trial? " I knew there were issues at Voorhees when my daughter continued to have sinus infections. I later learned that many of her classmates were sick as well. One of her friends then pointed out that many of the buildings had rain pouring in them, one in particular the science building. You could go inside the science building and see mold growing between the bricks (looks bumpy) and around the vents you could see the black mold. On days when it rains heavily you the hallway has water up to your ankles. I have been told that the roof is being repaired. The repair will not correct the actual problem. This building and other such buildings should be condemned. Many health problems could result from the mold. "

By me being a student at Voorhees College I have had more than one opportunity to speak with Dr. Monroe and even his wife. Dr. Monroe has stated to us(the student body) numerous changes that were to occur which the uplifting of the college's appearance among other problems. Did you think that this is respectful? I remember at one of your speeches you talked about making a change, well it is time. You need to evaluate yourself and what has happened. This college had some hard working professors here but now look at it. There are more students leaving the school than coming in. Voorhees has lost SEVERAL good employees because of this, I'm one of them. When will someone on the Board of Trustees wake up and do something before it is too late, or is it too late? Why in the world did Human Resources let this happen?? If they would have done their job then maybe this would have been avoided. This type of stuff makes Voorhees, the Episcopal Church and Denmark look bad. Denmark has enought negative things going on, now this. I would not want my child attending a college where a President has been accused of sexual harrassment. He needs to be fired immediately, if they expect to have any new freshman in the fall. How can you recruit someone to come to Voorhees now?? "

" Dr. Lee Monroe needs to go; he has cost this college, students and alum great embarrassment. I have a son who attends Voorhees College now and doing great and I also graduated from the college. I read that the college will support that man bothered me because I teach my kids wrong is wrong. This will hurt the parents and the students because I know that tuition will go up next year, Voorhees have to pay the Dr. Moreen B. Joseph some way and it will come out of the pockets of the parents and students that attend this college. I don’t know Dr. Monroe personally but from what I read in the newspaper about the water last summer and the sexually harassment and what my son told me about him, I can conclude that he’s not the right Leader for Voorhees College. I look at SCSU, Claflin, and even Dr. Swinton at Benedict with his problems, don't compare to what VC is going through. "
