Charges dropped against former Santee police chief

The charges against former Santee Police Chief Kenneth McCaster were thrown out Tuesday.

Deputy Chief Magistrate Cecil Moore dismissed the charges, finding not enough evidence for the trial to go forward.

On March 20, the 44-year-old McCaster was arrested and charged after a S.C. Highway Patrolman said he observed a vehicle that was not moving through an Orangeburg intersection. The trooper said he noticed the driver was asleep at the wheel and the vehicle's transmission was in park.

McCaster was charged with improper parking of a vehicle, public disorderly conduct and open container.

On April 16, McCaster tendered his resignation as the Santee's police chief, effective immediately.

" Ok I want the arresting officer dumped for unequal application of the law. Deriliction of duty or something. As I said earlier this year I dare anyone to try this same stunt:Go sit at a red light with a couple drinks in you and a cold one tween your legs. Fall asleep and wait for the man to come knock on your window.If this was a true case of how such circumstances are normally handled by law enforcement you should have nothing to worry about as relates to a DUI charge.
Is anyone brave enough to test the theory?

McCaster was already given special treatment when a field sobriety test was never administered.
How can anyone respest the Magistrate system when Chief Moore hands down decisions like this? "
