Judge grants bond for man accused of shooting 2 others 3 times each

Much to the dismay of the victims' family members, bond was set Wednesday on an Elloree man accused of shooting two people at a Santee nightclub.

Charged with two counts of assault and battery of a high and aggravated nature, 29-year-old Jason C. Shivers had his bond set at $75,000.

"Please be aware a warrant will be issued if you fail to show up for your trial," Orangeburg County Magistrate Derrick Dash said. "You do have a right to a trial by jury."

Of the nine family members of the two victims shot during an incident early Saturday, several appeared to be less than satisfied with Wednesday's outcome.

"It makes me think that the sheriff's department is on the take," said a cousin of the victims. "They can't just do these things and get away with it."

None of the victims' family members wished to identify themselves, citing their allegation that the defendant's family has ties with the legal system.

"It's ridiculous," another relative said of the bond. "I am absolutely upset."

Orangeburg County Sheriff's Detective Billy Ethridge had asked that a higher bond amount be placed on Shivers, citing the West Harlin Street man's criminal history.

In 1999, Ethridge said, Shivers served time for stabbing his brother to death in March of that year. He pleaded guilty to involuntary manslaughter and was sentenced to four months in prison.

"The severity of the crime, he does have a (criminal) history, we ask for a $150,000 bond," Ethridge said. Both victims were shot three times."

Shackled, Shivers kept his eyes on Dash as OCSO Victim's Advocate Thais Britt asked that the judge stipulate there be no contact between the Elloree man and the victims. She also requested bond be denied.

"In as far as bond being denied, I won't do that," Dash said. "As of a $100,000 bond, I won't do that. I will set a $75,000 bond."

The two victims, one a Eutawville man in his late 20s, have been released from the hospital, Etheridge said.

Police were called to the Stacy Gilmore Club on Isaac Gilmore Street in Santee after a report of a shooting around 2:25 a.m.

Deputies arrived to find the two men, one having suffered a gunshot wound to the upper right arm and lower right leg while the other had been shot in the arm.

Investigators said a dispute arose over a woman who accompanied Shivers to the nightclub. The encounter escalated to the shots being fired.

The victims' family members present at the Wednesday hearing, however, said the shooter approached their relatives, as opposed to any encroachment by their kin.

In either scenario, there would have been a hail of gunfire in the nightclub parking lot if each victim was struck three times apiece. Two nearby vehicles were also struck by gunfire.

The victims were not able to ide.jpgy their assailant or give any description of him, according to an Orangeburg County Sheriff's Office incident report.

That same report indicates that several individuals interviewed by authorities said they heard Shivers was the shooter. But the investigating officers stated in the report that apparently no one saw the actual shooting.

" First of all, Jason and Judge Dash are not related. Second of all, how can the Sheriff's Dept. make an arrest without of evidence or witness. If the victim knows Jason did it why did he say he didn't know and if so many people saw, why isn't the victim's family trying to find them to build this case. So there is no need for the victim or his family to cry about the bonde because apparently they dont know what happened themselves. Furthermore, people should get their facts straight before they jeopardize Judge Dash's career for hear-say. Now that's STUPID, STUPIDS!!! "

" This is not much different then the Sept 99 murder of Sandra Gail Lee they arrested her boy and said they had enough evidence to convict him without DNA. Keep him jail 6 months then let him go for loss of evidence and lack of evidence? What gets me they are not trying to find out who murdered the girl! How do you think it makes her family and friends feel towards the Sheriff's Department.Great job guys still a murderer out on the streets!!! unsolved mysteries should look at this case!! "

" For starters regardless how you look at this situation the judge and Jason are cruel individuals…. How do u walk up to someone and start shooting and not know them… they are either on drugs or just crazy.. There have been a lot of witness everyone who was there and those who called in anonymous So for people to say there was NOOO witnesses that’s a LIE … so don’t act like he is innocent and they are just blaming him. IF you don’t know him ask around believe me four out of five people can answer and say that this boy is truly crazy so before u go and make comments know the facts…. Last but not as far as the judge these are small towns and everyone knows u and Jason are related....why not say u can’t take the case and give the family a fair chance…STUPID…. "

" it actually was reported that the victims and other witness did see the shooting. it seems they saying that the information was mishandled by an officer who is related to the shooter. now it seems that the judge handling bond also has family ties. like dho3rd said: they would not make an arrest without sufficient proof. news papers don't always tell an accurate story. DEFINITELY A CONFLICT OF INTEREST!! "

" The state ethics committee should be notified of Judge Dash’s non recusal, especially if there are family ties. But the first problem, in what “Brooklyn” eluded to, the persons that were at the club that night and saw something, should come forward for interviews. The statement by the victim’s cousin that the “Sheriff’s office is on the take for this”, is not true. The Sheriff’s office has nothing to do with setting bond that is the responsibility of the Judge, which goes back to my first statement. If the Sheriff’s office didn’t have enough evidence against the suspect, then an arrest would never have been made. "

" Doesn't sound like there's any evidence or witnesses and they don't know who shot them - why be upset that he got a bond? How does that make the sheriffs' dept on the take? Maybe if the people that were there would tell what they saw things would be different. "
