Sheriff: Facts at present not sufficient for murder charge

Investigators say they are still considering whether or not to file a murder charge against a Eutawville man believed to be involved in a shooting that left another man dead.

Napier Harris, 28, of 325 Gable Dr., who was arrested after the May 15 shooting in Eutawville, is in jail on a weapons charge but has not been charged with murder.

Orangeburg County Sheriff Larry Williams described what he says are "unusual circumstances" that have left Harris in jail on the weapons charge only.

"We haven't made a decision yet" on whether or not to charge Harris with murder, Williams said. "It's a situation where the facts at the present are not sufficient."

Harris has been charged with unlawful carrying of a weapon and is in jail on a $10,000 surety bond.

Henry James Clark, 32, of Dorchester Avenue, Orangeburg, died during the shoot-out just outside the Eutawville town limits. Police found Clark's body inside a vehicle parked outside Eutawville Town Hall. A woman said she drove the victim to that site.

Williams said the unusual circumstances surround conflicting testimony and allegations that haven't matched up.

"I just don't want to charge this individual if we're not certain," he said. "I want to make sure."

Clark, the victim, was out on bond while awaiting trial in connection with the fatal shooting of two men in 2007 in Berkeley County. Clark was also charged with first-degree burglary in connection with that case. Berkeley County authorities have said they believe the 2007 incident was drug related.
